HAVE YOU OR YOUR CLOSE FAMILY / RELATIVE BECOME VICTIMS OF ROAD ACCIDENTS AND YOU DO NOT KNOW WHAT TO DO NEXT?

We asked about an opinion of a lawyer so that the similarly afflicted could quickly understand the issue although the thoughts are mainly with their loved ones. Despite these miserable and hopeless feelings, it is essential to get familiar and understand the following legal terms at least for authentication, because different company representatives might soon begin to ring at your door. These representatives, who have somehow got to your case will be offering their representation and will try to manipulate you into a signature of documents you might not fully understand. This text refers to injuries and deaths inflicted by road accident caused by a stranger.
In case you or your loved ones have been caused damage to health or even life by the third party, you need to proceed quickly and uncompromisingly before a culprit, who harmed you this way, manages to prepare for your next steps.

When injured, you are entitled to compensation as follows:

a) compensation for lost profit,
b) compensation for pain and suffering
a) costs associated with treatment,
d) compensation for loss of social assertion

ad. a) In case that you have been caused health damage preventing you from working, going to work, working freelance or doing an arranged part-time job, you are temporarily working incompetent. Thus it is the culprit obliged to pay you the full compensation, as this was his unlawful acting (not giving right of way, falling asleep at the wheel, etc.). You are therefore entitled to the difference between the amount you would normally earn (if the incapacity occurred) and the amount that you will be paid by The Czech Social Security Administration from your health insurance.

ad. b) Even in cases of minor injuries that do not require sick leave, you are entitled to compensation for pain and suffering and the amount defined according to severity of the injury.

ad. c) The culprit is also obliged to pay all the costs which you have effectively paid in connection with treatment, including medical equipment, fees in a hospital or a doctor, fare to seek medical help etc.

ad. d) In cases when you have been caused harm which prevents you from long-term working (carrying heavy loads or any other activity that is no longer admissible in terms of health for you), you are entitled to reimbursement of losses that you incurred by not performing your job. In this case, you can also claim the difference between the income that you have achieved earning before the injury and that you are able to earn after the injury.
In the event that your family/relative suffered from fatal injury,it is necessary to proceed on much faster. The culprit, in such case, must be responsible for all the hardship and incalculable loss, which he/she caused to all family/relatives.

In such cases, the survivors, whether children, spouses, parents, siblings, partners and other loved ones can sue the culprit for considerable sums of money from the third party whose unlawful conduct caused the death of a loved one.

Until 2013, such compensation was statutory. Since 2014 it is defined by court, therefore these amounts may be several times higher when you get represented well. This amount is also attributable to compensation for maintenance obligation and funeral expenses compensation.

All the above-mentioned is, in case of a road accident, paid by road accident insurance from the relevant statutory insurance (damage liability). If the culprit has not concluded any statutory insurance it will be compensated by Czech Insurers’ Bureau.

As the guilty party does not pay a penny, which is not entirely fair, the culprit can be asked to compensate beyond the aforementioned matters, e.g. defamation of character. This ensures that the guilty party will be punished at least by having to reach into their pockets compensating from hundreds of thousands to millions.
